DMCA & Copyright Policy
Effective Date: Aug 4, 2026
USA Mind Studio (https://usamindstudio.com/) respects the intellectual property rights of others and expects the same respect for our own work. This DMCA & Copyright Policy explains the specific procedures we follow when copyright disputes arise on our Site.
This Policy operates under the Digital Millennium Copyright Act (DMCA) and specifically Section 512 of Title 17 of the U.S. Code (17 U.S.C. § 512). For our general intellectual-property framework, please refer to Section 4 of our Terms of Service.
1. Scope of This Policy
This Policy covers:
- How to submit a DMCA takedown notice if you believe content on our Site infringes your copyright.
- How to submit a counter-notification if you believe your content was removed from our Site in error.
- Our repeat infringer policy.
- How to report infringement of USA Mind Studio’s own content appearing on other websites.
This Policy does not cover: our general ownership statement (see Terms of Service §4.1), fair-use policy (see Terms of Service §4.2), or our prohibition on AI training data extraction (see Terms of Service §4.3).
2. Reporting Copyright Infringement to USA Mind Studio
If you are a copyright owner (or an authorized agent) and believe that content published on our Site infringes your copyright, you may submit a written notice under the DMCA. To be legally valid under 17 U.S.C. § 512(c)(3), your notice must include all of the following elements:
2.1 Required Elements of a DMCA Takedown Notice
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work you claim has been infringed. If your notice covers multiple works, you may include a representative list.
- Identification of the allegedly infringing material on our Site, with enough detail (such as the specific article URL and a description of the material within the article) to allow us to locate it.
- Your contact information — full name, mailing address, telephone number, and email address.
- A statement made in good faith that you believe the use of the material is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Notices that do not substantially comply with all six elements may not be legally effective and may result in delay.
3. Designated Copyright Agent
Please send DMCA takedown notices to our Designated Copyright Agent:
USA Mind Studio — Designated Copyright Agent Email: write@usamindstudio.com Subject line: “DMCA Takedown Notice” Website: https://usamindstudio.com/
Editorial note: For full DMCA “safe harbor” protection under 17 U.S.C. § 512(c), a service provider should also register its Designated Agent with the U.S. Copyright Office’s DMCA Designated Agent Directory. USA Mind Studio maintains this contact information as its public designation for DMCA correspondence.
4. Our Response to Valid DMCA Notices
Upon receipt of a facially valid DMCA notice, USA Mind Studio will:
- Review the notice for compliance with the elements listed in Section 2.1.
- Remove or disable access to the allegedly infringing material, typically within a reasonable timeframe;
- Notify the affected user (if the material was submitted by a user other than USA Mind Studio) of the removal, and provide a copy of the takedown notice;
- Advise the affected user of their right to submit a counter-notification under Section 5.
- Retain records of the notice and our response.
If a notice is materially incomplete or appears to be submitted in bad faith, we may request clarification before taking action.
5. Counter-Notification Procedure
If your content has been removed or disabled as a result of a DMCA notice, and you believe the removal was the result of mistake or misidentification, you may submit a counter-notification.
5.1 Required Elements of a Counter-Notification
To be valid under 17 U.S.C. § 512(g)(3), your counter-notification must include all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location at which it appeared before removal (e.g., the original URL).
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your contact information — full name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the United States, of any judicial district in which USA Mind Studio may be found), and that you will accept service of process from the original complainant or their agent.
5.2 Where to Send
Counter-notifications should be sent to the Designated Copyright Agent contact information in Section 3, with the subject line “DMCA Counter-Notification.”
5.3 What Happens Next
Under the DMCA:
- We will forward your counter-notification to the original complainant.
- If the complainant does not file a court action against you within 10 to 14 business days of receiving the counter-notification, we may restore the removed material.
- Whether and when to restore removed material remains subject to our editorial discretion within the bounds of applicable law.
6. Repeat Infringer Policy
USA Mind Studio has adopted and reasonably implements a repeat infringer policy in accordance with 17 U.S.C. § 512(i).
Users, contributors, or commenters who are the subject of repeated valid DMCA takedown notices may, at our discretion, have their access to the Site terminated, their comments removed, or their contributor privileges revoked — without prior notice.
We assess repeat-infringer status based on:
- The number and frequency of valid notices received;
- Whether counter-notifications have been submitted and how they were resolved;
- Any other relevant context (such as evidence of bad-faith conduct).
7. Misrepresentation and Bad-Faith Notices
Under 17 U.S.C. § 512(f), any person who knowingly and materially misrepresents:
- That material is infringing (in a takedown notice), or
- That material was removed or disabled by mistake (in a counter-notification),
may be liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, by the copyright owner, or by USA Mind Studio.
We take bad-faith takedown claims seriously and reserve the right to reject facially defective, harassing, or knowingly false notices, and to notify affected users of such attempts.
8. Reporting Infringement of USA Mind Studio’s Content
If you believe that another website, publication, or platform is reproducing, republishing, or otherwise using USA Mind Studio’s original editorial content without permission, we would like to hear from you.
Please email us at write@usamindstudio.com with the subject line “Content Infringement Report,” and include:
- The URL(s) on our Site where the original content appears;
- The URL(s) of the third-party site where the infringing content is published;
- A brief description of what has been copied (for example, article text, images, or site design).
We will review the report and, where warranted, may pursue action under the DMCA or other applicable law.
9. Text and Data Mining and AI Training
Consistent with Section 4.3 of our Terms of Service, USA Mind Studio expressly reserves all rights in its content against use for text and data mining, machine-learning training, large-language-model development, or any similar automated processing — whether commercial or non-commercial — without our prior written permission.
This reservation is intended to have the effect of an explicit machine-readable and human-readable opt-out under applicable copyright frameworks, including analogous provisions to Article 4 of the EU Digital Single Market Directive (2019/790) for readers accessing our Site from the European Union.
10. Trademarks
“USA Mind Studio” and any associated logos, taglines, and brand identifiers are trademarks of USA Mind Studio. Unauthorized use of these marks — including in a manner likely to cause confusion, deception, or dilution — is prohibited.
References to third-party trademarks (such as book titles, author names, publisher names, or product names) on our Site are made for editorial purposes only and do not imply any affiliation, sponsorship, or endorsement.
To report unauthorized use of USA Mind Studio’s trademarks, please contact us at write@usamindstudio.com with the subject line “Trademark Concern.”
